class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h1 class=\"p1\">Additional Birth Leave<\/h1><h2 class=\"p1\">(prior to implementing decree)<\/h2><h2 class=\"p1\">1. What is additional birth leave?<\/h2><p class=\"p1\">Additional birth leave is a new right for parents, created by the Social Security Financing Act for 2026. It is in addition to existing leave (maternity, paternity and child care\/adoption) and aims to allow parents to spend more time with their child in the first months after birth or adoption.<\/p><p class=\"p2\">This leave does not replace parental leave or existing leave (maternity\/paternity).<\/p><p class=\"p3\">It can be taken immediatly following maternity leave.<\/p><h2 class=\"p1\">2. Who is it for?<\/h2><p class=\"p1\">The following are eligible:<\/p><ul><li class=\"p1\">Any parent of a child born or adopted on or after 1 January 2026 (or born prematurely when the expected date was on or after that date).<\/li><li class=\"p1\">Employed parents, self-employed workers, civil servants, non-salaried agricultural workers, etc., provided they meet the eligibility requirements at the time of application.<\/li><\/ul><p class=\"p2\"><strong>This leave is an individual right and is not transferable between parents.<\/strong><\/p><h2 class=\"p1\">3. How long does it last?<\/h2><p class=\"p1\">Each parent may choose:<\/p><ul><li class=\"p1\">1 month or 2 months of paid leave,<\/li><li class=\"p1\">which can be split into two 1-month periods if desired.<\/li><\/ul><p class=\"p1\"><strong>4. Conditions of implementation (when &amp; how)<\/strong><\/p><p class=\"p4\"><span class=\"s2\">Effective date:<\/span><\/p><p class=\"p5\">The scheme will be available from 1 July 2026.<\/p><h2 class=\"p1\">Deadline for taking leave:<\/h2><p class=\"p1\">Leave must be taken within 9 months after the birth or arrival ( following adoption) of the\u00a0child in the house of the parents.<\/p><h2 class=\"p1\">Procedures for employees:<\/h2><p class=\"p1\">The employer must be notified at least one <span class=\"s1\">month** <\/span>before the start of the leave, specifying:<\/p><p class=\"p1\">&#8211; the start date of the birth leave<\/p><p class=\"p1\">&#8211; the chosen duration<\/p><p class=\"p1\">&#8211; whether the leave is split into separate periods or not.<\/p><p class=\"p1\">**This period is reduced to 15 days if the leave begins immediately after paternity\/childcare or adoption leave.<\/p><h2 class=\"p1\">5. Remuneration (the decree will specify exactly how it is calculated)<\/h2><p class=\"p1\">Leave is compensated by Social Security (CPAM) according to a sliding scale:<\/p><ul><li class=\"p1\">1st month: approximately 70% of previous net salary (up to the Social Security ceiling:<\/li><\/ul><p class=\"p1\">\u20ac4,005 per month in 2026),<\/p><ul><li class=\"p1\">2nd month: approximately 60% of previous net salary (up to the social security ceiling:<\/li><\/ul><p class=\"p1\">\u20ac4,005 per month in 2026),<\/p><ul><li class=\"p1\">Capped at the Social Security thresholds).<\/li><\/ul><h2 class=\"p1\">6. Important conditions<\/h2><ul><li class=\"p1\">Birth leave is in addition to statutory leave: maternity, paternity or adoption.<\/li><li class=\"p1\">It cannot be taken at the same time as certain other benefits, such as parental leave allowance.<\/li><li class=\"p1\">There is no specific length of service requirement within the company for this leave (unlike parental leave).<\/li><\/ul><h2 class=\"p1\">7. Summary<\/h2><ul><li class=\"p1\">Each parent has this individual and personal right; it cannot be transfered to the other parent.<\/li><li class=\"p1\">This leave can be taken simultaneously or alternately by the parents.<\/li><li class=\"p1\">A certain extension of the deadline is planned for children born at the beginning of 2026 to compensate for the delayed implementation of the scheme.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Starting your business with us is easy!
