data-end=\"697\">Qui est concern\u00e9 par cette organisation du temps de travail ?<\/strong><br data-start=\"697\" data-end=\"700\" \/>Les salari\u00e9s concern\u00e9s sont ceux qui ont une totale autonomie dans l\u2019organisation de leurs t\u00e2ches et de leur temps de travail, et ceux dont les fonctions ne les obligent pas \u00e0 suivre les horaires d\u2019ouverture des bureaux.<br data-start=\"920\" data-end=\"923\" \/>Sont \u00e9galement concern\u00e9s les salari\u00e9s dont le temps de travail ne peut \u00eatre pr\u00e9d\u00e9termin\u00e9 et qui ont une autonomie r\u00e9elle pour organiser leur temps afin de remplir leurs responsabilit\u00e9s professionnelles.<\/p><p data-start=\"1129\" data-end=\"1384\"><strong data-start=\"1129\" data-end=\"1144\">ATTENTION !<\/strong><br data-start=\"1144\" data-end=\"1147\" \/>Un salari\u00e9 dont l\u2019organisation du temps de travail et le contenu des t\u00e2ches sont planifi\u00e9s par le responsable hi\u00e9rarchique ne peut pas b\u00e9n\u00e9ficier du forfait jours, car il n\u2019appartient pas \u00e0 la cat\u00e9gorie des salari\u00e9s dits \u00ab autonomes \u00bb.<\/p><p data-start=\"1386\" data-end=\"1907\"><strong data-start=\"1386\" data-end=\"1460\">Quand peut-on mettre en place cette organisation du temps de travail ?<\/strong><br data-start=\"1460\" data-end=\"1463\" \/>La mise en \u0153uvre du Forfait Jours est soumise \u00e0 l\u2019existence d\u2019un accord collectif, soit par le biais de la Convention Collective Nationale, soit d\u2019un accord d\u2019entreprise, soit d\u2019un accord de Branche, ou \u00e0 d\u00e9faut par un accord individuel.<br data-start=\"1700\" data-end=\"1703\" \/>Si le poste (Cadre ou Non-Cadre) correspond aux crit\u00e8res ci-dessus, et que le salari\u00e9 accepte les conditions li\u00e9es au Forfait Jours, l\u2019employeur peut r\u00e9diger une Convention de Forfait qui sera ins\u00e9r\u00e9e :<\/p><ul data-start=\"1908\" data-end=\"2095\"><li data-section-id=\"8dnfx3\" data-start=\"1908\" data-end=\"1982\">Dans le contrat de travail si le salari\u00e9 est au d\u00e9but de son embauche.<\/li><li data-section-id=\"ph0yqq\" data-start=\"1983\" data-end=\"2095\">Ou dans un amendement au contrat de travail existant, afin d\u2019en modifier l\u2019organisation du temps de travail.<\/li><\/ul><p data-start=\"2097\" data-end=\"2332\"><strong data-start=\"2097\" data-end=\"2162\">Quels sont les avantages li\u00e9s \u00e0 cette Convention de Forfait ?<\/strong><br data-start=\"2162\" data-end=\"2165\" \/>Les salari\u00e9s ayant accept\u00e9 et sign\u00e9 cet accord en mati\u00e8re d\u2019organisation du temps de travail ne sont plus soumis aux articles suivants du Droit du Travail Fran\u00e7ais :<\/p><ul data-start=\"2333\" data-end=\"2565\"><li data-section-id=\"1nkao7j\" data-start=\"2333\" data-end=\"2415\">Article L.3121-10 : dur\u00e9e hebdomadaire du temps de travail = 35 heures\/semaine<\/li><li data-section-id=\"15pbbfe\" data-start=\"2416\" data-end=\"2480\">Article L.3121-34 : dur\u00e9e journali\u00e8re du travail \u2264 10 heures<\/li><li data-section-id=\"1shxdos\" data-start=\"2481\" data-end=\"2565\">Article L.3121-35 : dur\u00e9e hebdomadaire maximale \u2264 48 heures dans la m\u00eame semaine<\/li><\/ul><p data-start=\"2567\" data-end=\"2623\"><strong data-start=\"2567\" data-end=\"2621\">R\u00e8gles imp\u00e9ratives \u00e0 respecter malgr\u00e9 le forfait :<\/strong><\/p><ul data-start=\"2624\" data-end=\"2769\"><li data-section-id=\"1xjsn48\" data-start=\"2624\" data-end=\"2703\">Minimum d\u2019un jour et demi de repos par semaine (habituellement le week-end)<\/li><li data-section-id=\"akioh4\" data-start=\"2704\" data-end=\"2769\">Minimum de 11 heures de repos entre deux journ\u00e9es travaill\u00e9es<\/li><\/ul><hr data-start=\"2771\" data-end=\"2774\" \/><p data-start=\"2776\" data-end=\"2808\"><strong data-start=\"2776\" data-end=\"2806\">Cong\u00e9s et jours de travail<\/strong><\/p><ul data-start=\"2809\" data-end=\"3003\"><li data-section-id=\"4dabll\" data-start=\"2809\" data-end=\"2876\">Le salari\u00e9 doit pouvoir b\u00e9n\u00e9ficier de 25 jours de cong\u00e9s pay\u00e9s.<\/li><li data-section-id=\"3nru2u\" data-start=\"2877\" data-end=\"3003\">Maximum de jours \u00e0 travailler par an : 218 jours (janvier \u00e0 d\u00e9cembre), ajustable selon la Convention Collective Nationale.<\/li><\/ul><p data-start=\"3005\" data-end=\"3064\">Le salari\u00e9 doit compl\u00e9ter un planning mensuel indiquant :<\/p><ul data-start=\"3065\" data-end=\"3133\"><li data-section-id=\"4ha2pm\" data-start=\"3065\" data-end=\"3133\">Absences pour maladie<\/li><\/ul><p data-start=\"3135\" data-end=\"3257\">Ce planning doit \u00eatre conserv\u00e9 et tenu \u00e0 disposition de l\u2019employeur et de l\u2019Inspection du Travail pendant 3 ans minimum.<\/p><p data-start=\"3259\" data-end=\"3395\"><strong data-start=\"3259\" data-end=\"3280\">Absences maladies<\/strong><br data-start=\"3280\" data-end=\"3283\" \/>Les absences maladies sont d\u00e9duites du forfait jours afin de pr\u00e9server le nombre de jours \u00e0 travailler par an.<\/p><p data-start=\"3397\" data-end=\"3596\"><strong data-start=\"3397\" data-end=\"3436\">RTT (R\u00e9duction du temps de travail)<\/strong><br data-start=\"3436\" data-end=\"3439\" \/>Les salari\u00e9s sous Forfait Jours b\u00e9n\u00e9ficient de jours compl\u00e9mentaires de cong\u00e9s pay\u00e9s appel\u00e9s \u00ab RTT \u00bb pour compenser les heures suppl\u00e9mentaires travaill\u00e9es.<\/p><p data-start=\"3598\" data-end=\"3627\"><strong data-start=\"3598\" data-end=\"3625\">Calcul des jours de RTT<\/strong><\/p><ul data-start=\"3628\" data-end=\"3889\"><li data-section-id=\"1dz5ybk\" data-start=\"3628\" data-end=\"3679\">Nombre de
