et les charges sociales sont payables en France (Cf : Main Issues : Social Contributions) &#8211; Convention de Rome 19.06.1980.<\/p><p data-start=\"441\" data-end=\"694\"><strong data-start=\"441\" data-end=\"489\">La D\u00e9claration Pr\u00e9alable \u00e0 l\u2019Embauche (DPAE)<\/strong><br data-start=\"489\" data-end=\"492\" \/>Ce formulaire doit \u00eatre rempli obligatoirement et transmis dans un d\u00e9lai minimum de 24 heures avant l\u2019embauche via internet. Cette d\u00e9claration ne peut avoir lieu que si le num\u00e9ro SIRET est disponible.<\/p><p data-start=\"696\" data-end=\"932\"><strong data-start=\"696\" data-end=\"721\">Le Contrat de Travail<\/strong><br data-start=\"721\" data-end=\"724\" \/>Lors de l\u2019embauche d\u2019un salari\u00e9 en France, l\u2019employeur est dans l\u2019obligation de pr\u00e9senter un contrat de travail en version fran\u00e7aise \u00e0 son nouveau salari\u00e9. La traduction du contrat n\u2019a pas de valeur l\u00e9gale.<\/p><p data-start=\"934\" data-end=\"1012\">Les clauses g\u00e9n\u00e9rales suivantes doivent figurer dans le contrat de travail :<\/p><ul data-start=\"1013\" data-end=\"1534\"><li data-section-id=\"1bph1vl\" data-start=\"1013\" data-end=\"1039\">L\u2019identit\u00e9 des parties<\/li><li data-section-id=\"74s053\" data-start=\"1040\" data-end=\"1127\">La Convention Collective de rattachement &amp; le coefficient hi\u00e9rarchique de r\u00e9f\u00e9rence<\/li><li data-section-id=\"1huotqx\" data-start=\"1128\" data-end=\"1189\">Le lieu de travail, le titre, grade ou qualit\u00e9 du salari\u00e9<\/li><li data-section-id=\"1o3bum\" data-start=\"1190\" data-end=\"1346\">La date de d\u00e9but du travail et la dur\u00e9e de la p\u00e9riode d\u2019essai, s\u2019il y en a une car la p\u00e9riode d\u2019essai n\u2019est pas obligatoire (mais hautement recommand\u00e9e)<\/li><li data-section-id=\"71g8z4\" data-start=\"1347\" data-end=\"1381\">Les divers \u00e9l\u00e9ments du salaire<\/li><li data-section-id=\"w8brw5\" data-start=\"1382\" data-end=\"1419\">La p\u00e9riodicit\u00e9 de la r\u00e9mun\u00e9ration<\/li><li data-section-id=\"aly1hu\" data-start=\"1420\" data-end=\"1534\">Le temps de travail : 35 heures ou plus par semaine &#8211; Forfait annuel en jours &#8211; Forfait hebdomadaire en heures<\/li><\/ul><h2 data-start=\"1536\" data-end=\"1574\"><strong data-start=\"1536\" data-end=\"1572\">Les types de Contrats de Travail<\/strong><\/h2><p data-start=\"1536\" data-end=\"1574\"><strong data-start=\"1576\" data-end=\"1615\">Le Contrat \u00e0 Dur\u00e9e D\u00e9termin\u00e9e (CDD)<\/strong><br data-start=\"1615\" data-end=\"1618\" \/>Ce contrat de travail est conclu pour l\u2019ex\u00e9cution d\u2019une t\u00e2che pr\u00e9cise et temporaire et seulement dans l\u2019un des cas bien pr\u00e9cis suivants :<\/p><ul data-start=\"1758\" data-end=\"1991\"><li data-section-id=\"1c1vsp2\" data-start=\"1758\" data-end=\"1821\">pour remplacer un salari\u00e9 absent (par ex : cong\u00e9 maternit\u00e9)<\/li><li data-section-id=\"12g47gf\" data-start=\"1822\" data-end=\"1882\">pour faire face \u00e0 un accroissement temporaire d\u2019activit\u00e9<\/li><li data-section-id=\"16346d5\" data-start=\"1883\" data-end=\"1924\">pour un emploi \u00e0 caract\u00e8re saisonnier<\/li><li data-section-id=\"1m7k9jm\" data-start=\"1925\" data-end=\"1991\">pendant l\u2019attente de la prise de fonction d\u2019un nouveau salari\u00e9<\/li><\/ul><p data-start=\"1993\" data-end=\"2103\">La dur\u00e9e du CDD varie selon le type de CDD mis en place. Attention aux crit\u00e8res et d\u00e9lais de renouvellement.<\/p><p data-start=\"2105\" data-end=\"2428\"><strong data-start=\"2105\" data-end=\"2146\">Le Contrat \u00e0 Dur\u00e9e Ind\u00e9termin\u00e9e (CDI)<\/strong><br data-start=\"2146\" data-end=\"2149\" \/>C\u2019est le contrat le plus couramment conclu. Son terme n\u2019est pas fix\u00e9 d\u2019avance. L\u2019employeur et\/ou le salari\u00e9 se r\u00e9servent le droit de le r\u00e9silier \u00e0 tout moment le contrat de travail, selon les proc\u00e9dures l\u00e9gales et conventionnelles (cf : Focus on : diff\u00e9rents types de rupture).<\/p><p data-start=\"2430\" data-end=\"2596\">NB : nous recommandons une p\u00e9riode d\u2019essai pour ce type de contrat, en ad\u00e9quation avec le profil des salari\u00e9.e.s (de 1 \u00e0 4 mois avec possibilit\u00e9 de renouvellement).<\/p><p data-start=\"2598\" data-end=\"2723\"><strong data-start=\"2598\" data-end=\"2628\">Le Contrat \u00e0 Temps partiel<\/strong><br data-start=\"2628\" data-end=\"2631\" \/>Le salari\u00e9 a les m\u00eames avantages que les salari\u00e9s \u00e0 temps complet. Possible en CDD et CDI.<\/p><h1 data-section-id=\"1v4l62z\" data-start=\"220\" data-end=\"255\"><span role=\"text\"><strong data-start=\"222\" data-end=\"255\">Autres formalit\u00e9s \u00e0 effectuer<\/strong><\/span><\/h1><ul data-start=\"257\" data-end=\"835\"><li data-section-id=\"m5ngia\" data-start=\"257\" data-end=\"427\">S\u2019immatriculer aupr\u00e8s d\u2019un organisme de Pr\u00e9voyance et sant\u00e9 compl\u00e9mentaire (Mutuelle d\u2019entreprise: obligatoire depuis le 01.01.2016). Cf Mains issues contrats groupe.<\/li><li data-section-id=\"v0y64i\" data-start=\"429\" data-end=\"478\">Tenir \u00e0 jour un registre unique du Personnel.<\/li><li data-section-id=\"1eid9n1\" data-start=\"480\" data-end=\"755\">R\u00e9aliser une visite d&rsquo;information et de pr\u00e9vention (Vip) dans les 3 mois suivant l\u2019embauche. Cette visite est effectu\u00e9e par le m\u00e9decin du travail ou par un professionnel de sant\u00e9 au travail dont l\u2019objet est d&rsquo;interroger le salari\u00e9 sur son \u00e9tat de sant\u00e9.
