TRAVAIL \u2013 OCCUPATIONAL MEDECINE Health &amp; Safety<\/strong><\/span><\/h1><p data-start=\"295\" data-end=\"619\">D\u00e8s l\u2019embauche de son premier salari\u00e9, toute nouvelle entreprise en France se doit d\u2019adh\u00e9rer \u00e0 un centre de M\u00e9decine du travail local proche de son si\u00e8ge social. Si l\u2019entreprise embauche du personnel travaillant \u00e0 distance, le centre de M\u00e9decine du travail devra se trouver \u00e0 proximit\u00e9 de l\u2019adresse personnelle du salari\u00e9.<\/p><p data-start=\"621\" data-end=\"998\">Depuis le 1er Janvier 2017, la visite m\u00e9dicale d\u2019embauche est remplac\u00e9e par la visite d\u2019information et de pr\u00e9vention (Vip), loi El Khomri du 08 ao\u00fbt 2016 &#8211; D\u00e9cret du 27 d\u00e9cembre 2016 n\u00b02016-1908.<br data-start=\"816\" data-end=\"819\" \/>Cette visite d\u2019information est obligatoire pour tous salari\u00e9s en CDD ou CDI et quelle que soit la dur\u00e9e du contrat. En revanche les stagiaires ne sont pas soumis \u00e0 cette visite.<\/p><h2 data-section-id=\"1snlwcy\" data-start=\"1005\" data-end=\"1037\"><span role=\"text\"><strong data-start=\"1008\" data-end=\"1037\">1. Qu\u2019est-ce que la Vip ?<\/strong><\/span><\/h2><p data-start=\"1039\" data-end=\"1062\">La Vip a pour objet :<\/p><ul data-start=\"1064\" data-end=\"1366\"><li data-section-id=\"1e0uh8k\" data-start=\"1064\" data-end=\"1114\">d&rsquo;interroger le salari\u00e9 sur son \u00e9tat de sant\u00e9,<\/li><li data-section-id=\"6itws8\" data-start=\"1115\" data-end=\"1177\">de l&rsquo;informer sur les risques li\u00e9s \u00e0 son poste de travail,<\/li><li data-section-id=\"1ix1l81\" data-start=\"1178\" data-end=\"1248\">de le sensibiliser sur les moyens de pr\u00e9vention \u00e0 mettre en \u0153uvre,<\/li><li data-section-id=\"esebjx\" data-start=\"1249\" data-end=\"1366\">et de l&rsquo;informer de son droit de b\u00e9n\u00e9ficier, \u00e0 tout moment, d&rsquo;une visite \u00e0 sa demande avec le m\u00e9decin du travail.<\/li><\/ul><p data-start=\"1368\" data-end=\"1391\">La Vip est r\u00e9alis\u00e9e :<\/p><ul data-start=\"1393\" data-end=\"1575\"><li data-section-id=\"17uvk5x\" data-start=\"1393\" data-end=\"1477\">soit par le m\u00e9decin du travail (qui exerce dans un service de sant\u00e9 au travail),<\/li><li data-section-id=\"1thfnd8\" data-start=\"1478\" data-end=\"1575\">soit par un professionnel de sant\u00e9 (par exemple, par un interne en m\u00e9decine ou un infirmier).<\/li><\/ul><p data-start=\"1577\" data-end=\"1779\">\u00c0 l&rsquo;issue de toute Vip, un dossier m\u00e9dical en sant\u00e9 au travail est \u00e9tabli et le m\u00e9decin du travail ou le professionnel de sant\u00e9 d\u00e9livre une attestation de suivi au travail au salari\u00e9 et \u00e0 l&#8217;employeur.<\/p><p data-start=\"1781\" data-end=\"2064\">En cas d&rsquo;affectation \u00e0 un poste \u00e0 risque (amiante, plomb, etc.), le travailleur b\u00e9n\u00e9ficie d&rsquo;un suivi individuel renforc\u00e9, pr\u00e9vus par l\u2019article R.4624-23 du Code du travail. Il en va de m\u00eame de tout poste pour lequel l\u2019affectation est conditionn\u00e9e \u00e0 un examen d\u2019aptitude sp\u00e9cifique.<\/p><h2 data-section-id=\"e14f4d\" data-start=\"2071\" data-end=\"2102\"><span role=\"text\"><strong data-start=\"2074\" data-end=\"2102\">2. P\u00e9riodicit\u00e9 de la Vip<\/strong><\/span><\/h2><p data-start=\"2104\" data-end=\"2412\">Cette visite est r\u00e9alis\u00e9e dans un d\u00e9lai maximum de 3 mois \u00e0 partir de la prise effective du poste de travail. Toutefois, pour les travailleurs de nuit et les salari\u00e9s de moins de 18 ans, cette visite doit \u00eatre r\u00e9alis\u00e9e avant leur affectation \u00e0 leur poste, c\u2019est-\u00e0-dire avant le d\u00e9but de la p\u00e9riode d\u2019essai.<\/p><p data-start=\"2414\" data-end=\"2477\">Au minimum, le salari\u00e9 doit passer une visite tous les 5 ans.<\/p><p data-start=\"2479\" data-end=\"2637\">La visite d\u2019information et de pr\u00e9vention n\u2019est pas obligatoire pour le salari\u00e9 qui a b\u00e9n\u00e9fici\u00e9 d\u2019une telle visite dans les 5 ans pr\u00e9c\u00e9dant son embauche si :<\/p><ul data-start=\"2639\" data-end=\"3056\"><li data-section-id=\"hbii03\" data-start=\"2639\" data-end=\"2738\">il est appel\u00e9 \u00e0 occuper un emploi identique et pr\u00e9sentant des risques d\u2019exposition \u00e9quivalents,<\/li><li data-section-id=\"1k4oaoe\" data-start=\"2740\" data-end=\"2851\">la m\u00e9decine du travail est en possession de la derni\u00e8re attestation de suivi ou du dernier avis d\u2019aptitude,<\/li><li data-section-id=\"1423x7z\" data-start=\"2853\" data-end=\"3056\">aucune mesure individuelle (am\u00e9nagement, transformation, adaptation du poste etc.), ou aucun avis d\u2019inaptitude n\u2019a \u00e9t\u00e9 \u00e9mis au cours des trois derni\u00e8res ann\u00e9es (Article R.4624-15 du Code du travail).<\/li><\/ul><p data-start=\"3058\" data-end=\"3096\">Il s\u2019agit de conditions cumulatives.<\/p><h3 data-section-id=\"fxnq73\" data-start=\"3098\" data-end=\"3115\"><span role=\"text\"><strong data-start=\"3102\" data-end=\"3115\">A noter :<\/strong><\/span><\/h3><ul data-start=\"3117\" data-end=\"3599\"><li data-section-id=\"jct27\" data-start=\"3117\" data-end=\"3433\">les femmes enceintes, venant d\u2019accoucher ou allaitantes, sont orient\u00e9es \u00e0 l\u2019issue de la visite d\u2019information et de pr\u00e9vention ou lorsqu\u2019elles le souhaitent vers le m\u00e9decin du travail qui organise une nouvelle visite ayant pour objet de proposer si n\u00e9cessaire, les adaptations de poste ou changement d\u2019affectation<\/li><li data-section-id=\"1y48g9m\" data-start=\"3435\" data-end=\"3599\">Dans le cas particulier des salari\u00e9s temporaires, la Vip peut \u00eatre effectu\u00e9e pour plusieurs emplois dans la limite de 3. (Article R.4625-10 du Code du travail).<\/li><\/ul><h2 data-section-id=\"1mccdq1\" data-start=\"3606\" data-end=\"3664\"><span role=\"text\"><strong data-start=\"3609\" data-end=\"3664\">3. Cons\u00e9quences des visites sur le temps de travail<\/strong><\/span><\/h2><p data-start=\"3666\" data-end=\"3772\">Le temps consacr\u00e9 pour les visites et les examens m\u00e9dicaux, y compris les examens compl\u00e9mentaires, est :<\/p><ul data-start=\"3774\" data-end=\"4009\"><li data-section-id=\"u5a2k9\" data-start=\"3774\" data-end=\"3881\">soit pris sur les heures de travail du salari\u00e9 sans qu&rsquo;aucune retenue de salaire ne puisse \u00eatre op\u00e9r\u00e9e,<\/li><li data-section-id=\"ebtee5\" data-start=\"3883\" data-end=\"4009\">soit r\u00e9mun\u00e9r\u00e9 comme temps de travail effectif lorsque ces examens ne peuvent pas avoir lieu pendant les heures de travail.<\/li><\/ul><p data-start=\"4011\" data-end=\"4084\">Le temps de transport et les frais sont pris en charge par l&#8217;employeur.<\/p><h2 data-section-id=\"189sbdo\" data-start=\"4091\" data-end=\"4107\"><span role=\"text\"><strong data-start=\"4094\" data-end=\"4107\">A noter :<\/strong><\/span><\/h2><p data-start=\"4109\" data-end=\"4696\">il est de la responsabilit\u00e9 totale de l\u2019employeur, qui est tenu \u00e0 une obligation g\u00e9n\u00e9rale de s\u00e9curit\u00e9 de r\u00e9sultat, de veiller \u00e0 la protection de la sant\u00e9 de ses salari\u00e9s. Il est \u00e0 l&rsquo;initiative de l&#8217;employeur d\u2019organiser les RDV avec le m\u00e9decin du travail.
