CONVENTIONNELLE \u2013 PROCEDURES &#8211; FRANCE<\/strong><\/span><\/h1><p data-start=\"306\" data-end=\"410\">L\u2019employeur et le salari\u00e9 peuvent d\u00e9cider de mettre fin par consentement mutuel au contrat de travail.<\/p><p data-start=\"412\" data-end=\"542\">Seul un CDI peut \u00eatre rompu de cette fa\u00e7on (temps plein ou temps partiel). Cela inclut les contrats d\u2019alternance conclus en CDI.<\/p><p data-start=\"544\" data-end=\"736\">Cette rupture r\u00e9sulte d\u2019une convention sign\u00e9e par les deux parties lors d\u2019un entretien.<br data-start=\"631\" data-end=\"634\" \/>Cette convention est soumise aux dispositions du droit du travail (art L1237-14 du code du travail).<\/p><p data-start=\"738\" data-end=\"890\">Il est \u00e0 noter que la rupture d\u2019un contrat de travail via la rupture conventionnelle permet au salari\u00e9 sortant d\u2019avoir acc\u00e8s \u00e0 des indemnit\u00e9s ch\u00f4mage.<\/p><h1 data-section-id=\"urd0qz\" data-start=\"897\" data-end=\"912\"><span role=\"text\"><strong data-start=\"899\" data-end=\"912\">PROCEDURE<\/strong><\/span><\/h1><h2 data-section-id=\"t85z9y\" data-start=\"919\" data-end=\"940\"><span role=\"text\"><strong data-start=\"922\" data-end=\"940\">1) L\u2019entretien<\/strong><\/span><\/h2><p data-start=\"942\" data-end=\"1093\">Il doit y avoir au moins un entretien pendant lequel le salari\u00e9 et l\u2019employeur conviennent conjointement d\u2019une rupture conventionnelle (terme l\u00e9gal).<\/p><p data-start=\"1095\" data-end=\"1155\">Lors de cet entretien, le salari\u00e9 peut se faire assister :<\/p><ul data-start=\"1157\" data-end=\"1325\"><li data-section-id=\"hek4r8\" data-start=\"1157\" data-end=\"1223\">soit par une personne de son choix appartenant \u00e0 l\u2019entreprise.<\/li><li data-section-id=\"b2e96b\" data-start=\"1224\" data-end=\"1325\">soit par un conseiller choisi sur une liste dress\u00e9e par l\u2019inspection du travail ou par la mairie.<\/li><\/ul><p data-start=\"1327\" data-end=\"1434\">S\u2019il choisit de se faire assister, il devra en avertir l\u2019employeur avant la date pr\u00e9vue pour l\u2019entretien.<\/p><p data-start=\"1436\" data-end=\"1557\">L\u2019employeur peut \u00e9galement se faire assister uniquement si le salari\u00e9 se fait assister. Il peut demander l\u2019assistance :<\/p><ul data-start=\"1559\" data-end=\"1747\"><li data-section-id=\"xivkb\" data-start=\"1559\" data-end=\"1624\">soit d\u2019une personne appartenant au personnel de l\u2019entreprise.<\/li><li data-section-id=\"12gxqgc\" data-start=\"1625\" data-end=\"1703\">soit d\u2019une personne appartenant \u00e0 une organisation syndicale d\u2019employeurs.<\/li><li data-section-id=\"ikgtir\" data-start=\"1704\" data-end=\"1747\">soit d\u2019un employeur de la m\u00eame branche.<\/li><\/ul><p data-start=\"1749\" data-end=\"1851\">L\u2019employeur qui se fait assister devra \u00e9galement en avertir le salari\u00e9 avant la date de l\u2019entretien.<\/p><p data-start=\"1853\" data-end=\"1965\"><strong data-start=\"1853\" data-end=\"1963\">Attention, lors de cet entretien, ni l\u2019employeur, ni le salari\u00e9, ne peut se faire assister par un avocat !<\/strong><\/p><p data-start=\"1967\" data-end=\"2224\">Lors de cet entretien, si les deux parties s\u2019accordent sur les conditions de rupture de contrat (date de fin de contrat et indemnit\u00e9 de rupture), elles peuvent remplir le formulaire de rupture conventionnelle 14598*01 (dit convention de rupture) ensemble.<\/p><p data-start=\"2231\" data-end=\"2416\"><strong data-start=\"2231\" data-end=\"2414\">Attention, depuis le 1er avril 2022, le formulaire de rupture conventionnelle est obligatoirement t\u00e9l\u00e9transmis via le site TELERC (site gouvernemental d\u00e9di\u00e9 \u00e0 ce mode de rupture).<\/strong><\/p><p data-start=\"2418\" data-end=\"2574\">Nous recommandons de remplir le formulaire directement en ligne afin d\u2019obtenir les dates pr\u00e9cises \u00e0 respecter pour les diff\u00e9rentes \u00e9tapes de la proc\u00e9dure.<\/p><h2 data-section-id=\"1ejuu76\" data-start=\"2581\" data-end=\"2625\"><span role=\"text\"><strong data-start=\"2584\" data-end=\"2625\">2) La convention de rupture : contenu<\/strong><\/span><\/h2><p data-start=\"2627\" data-end=\"2663\">La convention de rupture indique :<\/p><ul data-start=\"2665\" data-end=\"5045\"><li data-section-id=\"fvp699\" data-start=\"2665\" data-end=\"2740\">Les coordonn\u00e9es des deux parties concern\u00e9es ET des \u00e9ventuels assistants<\/li><li data-section-id=\"fvu771\" data-start=\"2742\" data-end=\"2959\">L\u2019emploi, la qualification et anciennet\u00e9 du salari\u00e9 (l\u2019anciennet\u00e9 s\u2019appr\u00e9cie \u00e0 la date envisag\u00e9e de la rupture, et non \u00e0 la date de la signature de la convention de rupture et tient compte des ann\u00e9es incompl\u00e8tes).<\/li><li data-section-id=\"15z4kqi\" data-start=\"2961\" data-end=\"3011\">La Convention Collective Nationale applicable.<\/li><li data-section-id=\"1di7qla\" data-start=\"3013\" data-end=\"3249\">La r\u00e9mun\u00e9ration brute per\u00e7ue au cours des 12 derniers mois (Attention, si l\u2019employ\u00e9 (e) a \u00e9t\u00e9 malade au cours des 12 derniers mois, on indiquera le salaire brut complet qu\u2019il aurait per\u00e7u en travaillant son temps de travail normal).<\/li><li data-section-id=\"1dsmr8o\" data-start=\"3251\" data-end=\"3309\">La date du 1er entretien et des suivants s\u2019il y a lieu<\/li><li data-section-id=\"15jnjqs\" data-start=\"3311\" data-end=\"3858\">Le montant de l\u2019indemnit\u00e9 de rupture : ce montant est au moins \u00e9gal aux indemnit\u00e9s de licenciement conventionnelles (voir votre convention collective) ou l\u00e9gales (pas moins de 1\/4 de mois de salaire moyen calcul\u00e9 sur les 3 ou 12 derniers mois, multipli\u00e9 par le nombre d\u2019ann\u00e9es d\u2019anciennet\u00e9 selon le code du travail). Le montant peut \u00eatre \u00e9quivalent \u00e0 plusieurs mois de salaire. Il doit \u00eatre indiqu\u00e9 en lettres sur la convention de rupture. Attention, une fois le cerfa envoy\u00e9 et valid\u00e9, vous ne pourrez plus modifier le montant de l\u2019indemnit\u00e9.<\/li><li data-section-id=\"difllv\" data-start=\"3860\" data-end=\"4274\">La date envisag\u00e9e de la rupture du contrat de travail. Au lendemain de l\u2019entretien, il faut compter minimum 5 semaines calendaires (du lundi au dimanche) pour d\u00e9terminer la date de rupture de contrat. Le site TELERC calcule une date de fin par rapport \u00e0 la date de l\u2019entretien. Toutefois, rien n\u2019emp\u00eache les parties de pr\u00e9voir une date qui convienne \u00e0 chacun et qui sera plus \u00e9loign\u00e9e du d\u00e9lai minimal calcul\u00e9.<\/li><li data-section-id=\"1nnwjll\" data-start=\"4276\" data-end=\"4488\">La date et signature de chaque partie pr\u00e9c\u00e9d\u00e9e de la mention \u00ab lu et approuv\u00e9 \u00bb. Attention, dans le cas o\u00f9 les parties font l\u2019entretien en visioconf\u00e9rence, ils devront indiquer la m\u00eame date sur le formulaire.<\/li><li data-section-id=\"1qcibsk\" data-start=\"4490\" data-end=\"5045\">La date de fin du d\u00e9lai de r\u00e9tractation : \u00e0 partir du lendemain du jour o\u00f9 les deux parties se sont mises d\u2019accord sur le montant de l\u2019indemnit\u00e9 de rupture conventionnelle (cela peut \u00eatre d\u00e8s le lendemain du premier rendez-vous), vous avez droit \u00e0 un d\u00e9lai de r\u00e9tractation de 15 jours calendaires. Ainsi, si la date de fin de contrat est pr\u00e9vue 2 mois apr\u00e8s l\u2019entretien, le salari\u00e9 ne peut pr\u00e9tendre \u00e0 une indemnit\u00e9 de pr\u00e9avis de 3 mois comme pr\u00e9vu dans son contrat initial pour une rupture traditionnelle (d\u00e9mission ou licenciement). Toutefois, rien n\u2019emp\u00eache l\u2019employeur d\u2019augmenter le montant de l\u2019indemnit\u00e9 de rupture conventionnelle pour compenser \u00ab cette perte \u00bb pour le\/la salari\u00e9 (e).<\/p><h2 data-section-id=\"1vjtkjf\" data-start=\"5562\" data-end=\"5630\"><span role=\"text\"><strong data-start=\"5565\" data-end=\"5630\">3) Homologation de la convention de rupture conventionnelle :<\/strong><\/span><\/h2><p data-start=\"5632\" data-end=\"5944\">Une fois le formulaire t\u00e9l\u00e9transmis via TELERC, la DREETS (Direction R\u00e9gionale Interd\u00e9partementale de l\u2019Economie et des solidarit\u00e9s) dispose d\u2019un d\u00e9lai d\u2019instruction de 15 jours ouvrables (sont exclus les dimanches et jours f\u00e9ri\u00e9s). Ce d\u00e9lai d\u2019instruction d\u00e9marre au lendemain de la r\u00e9ception de votre demande.<\/p><p data-start=\"5946\" data-end=\"6080\">A d\u00e9faut de notification par la DREETS pass\u00e9 ce d\u00e9lai d\u2019instruction, l\u2019homologation de la convention de rupture est r\u00e9put\u00e9e acquise.<\/p><p data-start=\"6082\" data-end=\"6266\">Si l\u2019homologation est refus\u00e9e* dans ce d\u00e9lai de 15 jours ouvrables, l\u2019une des parties ou les deux peuvent former un recours contre ce refus d\u2019homologation. Le refus doit \u00eatre motiv\u00e9.<\/p><p data-start=\"6268\" data-end=\"6512\">*Depuis la cr\u00e9ation de la rupture conventionnelle en 2008, chaque refus que nous avons eu \u00e9tait li\u00e9 au non-respect des dates. Dans chaque cas, nous avons renvoy\u00e9 les demandes en corrigeant les dates et les ruptures ont toutes \u00e9t\u00e9 homologu\u00e9es.<\/p><p data-start=\"6514\" data-end=\"6747\">Tant que la date de rupture du contrat de travail indiqu\u00e9e dans la convention n\u2019est pas atteinte, les r\u00e8gles aff\u00e9rentes au contrat de travail continuent \u00e0 s\u2019appliquer. Le salari\u00e9 peut donc prendre des cong\u00e9s si l\u2019employeur accepte.<\/p><p data-start=\"6749\" data-end=\"6904\">Un recours juridictionnel reste possible jusqu\u2019\u00e0 12 mois apr\u00e8s la date d\u2019homologation de la convention de rupture.
