<\/i><\/p><p class=\"p5\">\u2022 Loi Evin du 31 D\u00e9cembre 1989<\/p><p class=\"p6\"><span class=\"s1\">\u2022 <\/span><i>Accords de Branche et conventions collectives dont la Con-vention collective nationale des <\/i><b><i>cadres <\/i><\/b><i>du 14.03.1947 instau-rant une cotisation minimum de 1.5% sur la Tr A <\/i><\/p><p class=\"p3\"><span class=\"s1\"><b>MUTUELLE: <\/b><\/span><b><i>Assurance sant\u00e9 compl\u00e9mentaire permettant un remboursement des frais m\u00e9dicaux du salari\u00e9 (et de sa famille si le contrat le stipule) non pris en charge par le r\u00e9gime g\u00e9n\u00e9ral de la S\u00e9curit\u00e9 sociale. <\/i><\/b><\/p><p class=\"p3\"><i>Les bases r\u00e8glementaires sont les suivantes en mati\u00e8re de compl\u00e9mentaire sant\u00e9 : <\/i><\/p><p class=\"p8\">\u2022 Accord National Interprofessionnel ( A.N.I) du 11 Janvier 2013<\/p><p class=\"p9\"><span class=\"s1\">\u2022 <\/span><i>Loi du 14 Juin 2013 relative \u00e0 la s\u00e9curisation de l\u2019emploi <\/i><\/p><p class=\"p9\"><span class=\"s1\">\u2022 <\/span><i>Decret n\u00b02014-1374 du 18 Novembre 2014 relatif au nouveau \u00ab Contrat Responsable \u00bb <\/i><\/p><p class=\"p10\">\u2022 Accords de Branche et conventions collectives<\/p><h2 class=\"p2\"><b>DANS LA PRATIQUE <\/b><\/h2><p class=\"p3\">Depuis le 1er janvier 2016, toutes les entreprises, quelles que soient leur taille, statut, secteur doivent faire b\u00e9n\u00e9ficier l\u2019ensemble de leurs salari\u00e9s:<\/p><p class=\"p12\"><span class=\"s1\">\u2022 <\/span>D\u2019un contrat pr\u00e9voyance ( elle n\u2019est obligatoire que pour les cadres, cependant il est plus prudent de le mettre en place pour tout le monde pour la protection des salari\u00e9s)<\/p><p class=\"p3\"><span class=\"s1\">\u2022 <\/span>D\u2019un contrat sant\u00e9 responsable dont les cotisations seront prises en charge \u00e0 50% minimum par l\u2019em-ployeur.<\/p><p class=\"p3\"><i>La mise en place de ces contrats se fait sans conditions d\u2019an-ciennet\u00e9 ou de cat\u00e9gorie et les <\/i><b><i>modalit\u00e9s d\u2019application <\/i><\/b><i>doi-vent \u00eatre communiqu\u00e9es aux salari\u00e9s par le biais de la <\/i><b><i>D\u00e9-claration Unilat\u00e9rale de l\u2019Employeur (DU), <\/i><\/b><i>qui en accusent r\u00e9ception en signant la liste d\u2019\u00e9margement. <\/i><b><i>Si l\u2019employeur choisit de ne faire adh\u00e9rer ses salari\u00e9s qu\u2019\u00e0 compter de la validation de la fin de la p\u00e9riode d\u2019essai, la DU doit le sp\u00e9-cifier. <\/i><\/b><\/p><p class=\"p3\"><b><i>ATTENTION!: si l\u2019employeur ne s\u2019acquitte pas de ses obliga-tions de souscription \u00e0 la pr\u00e9voyance, il devra lui-m\u00eame indemniser le salari\u00e9 ou sa famille, en cas de risques r\u00e9ali-s\u00e9s . Ce risque financier \u00e9tant non n\u00e9gligeable , une atten-tion particuli\u00e8re devra \u00eatre port\u00e9e \u00e0 la mise en oeuvre de ces contrats groupe obligatoires \u00e0 chaque embauche. <\/i><\/b><\/p><p class=\"p3\">Les employeurs doivent v\u00e9rifier si leur convention collective ne leur impose pas une institution sp\u00e9cifique et\/ou des taux et b\u00e9n\u00e9fices sp\u00e9cifiques.<\/p><p class=\"p3\">Si rien n\u2019est impos\u00e9, l\u2019employeur peut mettre en place les contrats avec l\u2019assureur de son choix.<\/p><p class=\"p1\">\u00a0<\/p><h2 class=\"p2\"><b>LES COTISATIONS <\/b><\/h2><p class=\"p3\"><b>Les cotisations aux contrats pr\u00e9voyance et sant\u00e9 font partie des contributions sociales payable mensuellement ou trimestriellement au m\u00eame titre que les autres charges sociales URSSAF, POLE Emploi et RETRAITE. <\/b><\/p><p class=\"p4\"><span class=\"s1\">\u2022 <\/span>La cotisation pr\u00e9voyance est bas\u00e9e sur l\u2019int\u00e9gralit\u00e9 du salaire brut divis\u00e9 en tranches A\/B\/C<\/p><p class=\"p3\"><span class=\"s1\">\u2022 <\/span>La cotisation mutuelle est uniquement calcul\u00e9e \u00e0 partir de la base du PMSS (plafond mensuel de la s\u00e9-curit\u00e9 sociale) \u00e9galement appel\u00e9e tranche A (3428\u20ac en 2022).<\/p><p class=\"p3\"><b>Pour rappel : TA TB <\/b><\/p><p class=\"p3\"><b>2022 3 428 Euros 13 712 Euros <\/b><\/p><h2 class=\"p2\"><b>LES TAUX <\/b><\/h2><p class=\"p3\"><b>Pr\u00e9voyance<\/b>: les taux d\u00e9pendent du statut (cadre ou non-cadre), de l\u2019\u00e2ge, des ant\u00e9c\u00e9dents m\u00e9dicaux (questionnaire m\u00e9dical) et de la Convention Collective. R\u00e9partition des couts employeur\/ employ\u00e9 \u00e0 d\u00e9finir pour la TB et TC.<\/p><p class=\"p6\">\u2022 Ex pour les Cabinets Conseil CCN 3018 IDCC 1486 SYNTEC<\/p><p class=\"p8\"><b>Non Cadres : Cadres <\/b><\/p><p class=\"p8\">TA 0.74 % 1.50 %<\/p><p class=\"p8\">TB 1.00 % 0.74 \u00e0 2.50 %<\/p><p class=\"p8\">TC 1.00 % 0.74 \u00e0 2.50 %<\/p><p class=\"p3\"><b>Mutuelle<\/b>: le taux varie selon la formule de garanties choisie (socle de base ou prise en charge des d\u00e9passements d\u2019hono-raires m\u00e9dicaux), du nombre d\u2019adh\u00e9rents \u00e0 couvrir (salari\u00e9 seul, ayants droits, famille) et de l\u2019\u00e2ge moyen du groupe.
