LES LICENCIEMENTS <\/b><\/h2><p class=\"p5\"><b>A. LICENCIEMENT ECONOMIQUE <\/b><\/p><p class=\"p5\"><b>Motif : <\/b>pour justifier un licenciement \u00e9conomique, la suppression de l\u2019emploi doit \u00eatre cons\u00e9cutive \u00e0 :<\/p><p class=\"p6\"><span class=\"s5\">&#8211; <\/span>Des difficult\u00e9s \u00e9conomiques cons\u00e9quentes non compensables par une autre soci\u00e9t\u00e9 du groupe ou mettant en p\u00e9ril l\u2019activit\u00e9 de la soci\u00e9t\u00e9 (fournir des donn\u00e9es chiffr\u00e9es).<\/p><p class=\"p6\"><span class=\"s5\">&#8211; <\/span>Une mutation technologique (d\u00e9localisation pour maintenir l\u2019activit\u00e9 de la soci\u00e9t\u00e9)<\/p><p class=\"p5\"><span class=\"s5\">&#8211; <\/span>Une r\u00e9organisation de l\u2019entreprise (pour maintenir l\u2019activit\u00e9 de la soci\u00e9t\u00e9)<\/p><p class=\"p5\"><b>B. LICENCIEMENT POUR CAUSE REELLE ET SERIEUSE <\/b><\/p><p class=\"p5\"><b>(Inclut toutes les autres formes de licenciements : motif personnel, faute (grave ou lourde). <\/b><\/p><p class=\"p5\"><b>Motif personnel : <\/b>invalidit\u00e9 ou \u00e9tat de sant\u00e9 ne permettant pas un maintien du salari\u00e9 dans l\u2019entreprise, insuffisance professionnelle du salari\u00e9. Dans ce cas, le salari\u00e9 part avec toutes les indemnit\u00e9s suivant une fin de contrat (indemnit\u00e9s de pr\u00e9avis, de licenciement et de cong\u00e9s pay\u00e9s) car le motif r\u00e9el et s\u00e9rieux ne pr\u00e9sente pas un caract\u00e8re fautif.<\/p><p class=\"p5\"><b>Faute grave : <\/b>faute qui rend impossible le maintien du salari\u00e9 dans l\u2019entreprise. La faute grave n\u2019est pas forc\u00e9ment intentionnelle, c\u2019est pourquoi l\u2019employeur n\u2019est pas tenu de prononcer une mise \u00e0 pied \u00e0 titre conservatoire. En revanche, le salari\u00e9 licenci\u00e9 pour faute grave, ne per\u00e7oit pas les indemnit\u00e9s de pr\u00e9avis et de licenciement. Toutefois, il per\u00e7oit les indemnit\u00e9s de cong\u00e9s pay\u00e9s.<\/p><p class=\"p5\"><b>Faute lourde : <\/b>faute commise par le salari\u00e9 avec intention de nuire \u00e0 l\u2019entreprise ou \u00e0 l\u2019employeur. Le salari\u00e9 licenci\u00e9 pour faute lourde ne per\u00e7oit aucune indemnit\u00e9 de fin de contrat.<\/p><p class=\"p5\"><b>N.B. : dans tous les cas de licenciement, quelle qu\u2019en soit la raison, le salari\u00e9 percevra des allocations ch\u00f4mage. <\/b><\/p><p class=\"p5\"><b>Le licenciement, quel qu\u2019en est le motif, doit ob\u00e9ir \u00e0 une proc\u00e9dure stricte, aussi, vous devez vous adresser \u00e0 un cabinet d\u2019avocats sp\u00e9cialis\u00e9 dans le droit du travail.<\/b><\/p><h2 class=\"p1\"><b>II. LA RUPTURE CONVENTIONNELLE <\/b><\/h2><p class=\"p1\">Rupture du contrat de travail par consentement mutuel entre le salari\u00e9 et l\u2019employeur.<\/p><p class=\"p1\">Seul un CDI peut \u00eatre rompu de cette fa\u00e7on.<\/p><p class=\"p1\">Cette rupture r\u00e9sulte d\u2019une convention sign\u00e9e (cerfa 14598*01) par les deux parties lors d\u2019un entretien.<\/p><p class=\"p1\">Cette convention est soumise aux dispositions du droit du travail (art 2242-15 du code du travail).<\/p><p class=\"p1\">Cf. notre PDR sur la rupture conventionnelle.<\/p><p class=\"p1\"><b>En cas de rupture conventionnelle, le salari\u00e9 percevra des allocations ch\u00f4mage. <\/b><\/p><h2 class=\"p1\"><b>III. LA DEMISSION <\/b><\/h2><p class=\"p1\">Le salari\u00e9 souhaite rompre son contrat. Il informe son employeur de sa d\u00e9cision.<\/p><p class=\"p1\"><b>N.B. : <\/b>M\u00eame si la loi ne pr\u00e9voit pas de r\u00e8gle sp\u00e9cifique de notification de la lettre de d\u00e9mission, nous pr\u00e9conisons d\u2019envoyer une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception, ou une remise en main propre contre d\u00e9charge.<\/p><p class=\"p1\">Le salari\u00e9 devra respecter un pr\u00e9avis l\u00e9gal ou conventionnel.<\/p><p class=\"p1\">N.B. : le salari\u00e9 ne per\u00e7oit normalement pas d\u2019allocations ch\u00f4mage, except\u00e9 dans certaines circonstances d\u00e9rogatoires.
