Statutory Sick Pay (SSP)<\/h1><p class=\"p2\">En cas de maladie, les salari\u00e9s peuvent b\u00e9n\u00e9ficier du Statutory Sick Pay (SSP) pay\u00e9 par l&#8217;employeur et dont le montant est fix\u00e9 chaque ann\u00e9e par le HMRC \/ Tax Office : 99,35 GBP \/ semaine (2022) payable pendant un maximum de 28 semaines.<\/p><p class=\"p2\">Le SSP est le montant minimum de salaire \u00e0 verser \u00e0 votre employ\u00e9 pendant sa maladie. Le montant \u00e9tant assez faible (environ 430 GBP pour un mois !), il est fortement recommand\u00e9 de compl\u00e9ter les droits SSP par des avantages suppl\u00e9mentaires \u00e0 d\u00e9finir dans une politique d&rsquo;indemnit\u00e9s de maladie de l&rsquo;entreprise (\u00e9galement appel\u00e9e Sick Pay scheme or Occupational scheme) et doit \u00eatre clairement indiqu\u00e9 dans le contrat de travail au d\u00e9part.<\/p><p class=\"p2\">Attention \u2013 Le SSP est diff\u00e9rent de l&rsquo;IJSS en France : il s&rsquo;agit d&rsquo;un minimum \u00e0 verser par l&#8217;employeur au Salari\u00e9 et pas un remboursement \u00e0 reverser par le HMRC \u00e0 l&rsquo;Employeur.<\/p><p class=\"p2\"><b>Conditions \u00e0 remplir par le salari\u00e9 pour b\u00e9n\u00e9ficier du \u00ab Statutory sick pay \u00bb : <\/b><\/p><ul><li class=\"p2\">\u00catre consid\u00e9r\u00e9 comme employ\u00e9 et avoir effectu\u00e9 un travail pour l\u2019employeur<\/li><li class=\"p2\">Il doit percevoir au minimum un revenu moyen brut de 123 \u00a3 par semaine en 2022<\/li><li class=\"p2\">Il doit \u00eatre malade, \u00ab self-isolating \u00bb or \u00ab shielding \u00bb pendant au moins 4 jours cons\u00e9cutifs (y compris les jours ch\u00f4m\u00e9s) &#8211; connu sous le nom de \u00ab p\u00e9riode d&rsquo;incapacit\u00e9 de travail\/ period of incapacity for work \u00bb. Cependant, l&rsquo;Employeur devra \u00e9galement tenir compte des p\u00e9riodes de maladie r\u00e9guli\u00e8res, qui peuvent \u00eatre consid\u00e9r\u00e9es comme des p\u00e9riodes de maladie li\u00e9es appel\u00e9es \u00ab <b>Linked periods of sickness \u00bb. <\/b><\/li><li class=\"p2\">Le salari\u00e9 doit d\u00e9clarer \u00e0 l&#8217;employeur qu&rsquo;il est malade avant le d\u00e9lai fix\u00e9 dans le contrat de travail &#8211; ou dans les 7 jours si cela n&rsquo;est pas pr\u00e9cis\u00e9 dans le contrat. Attention, il faut distinguer le fait d&rsquo;informer l&#8217;employeur du fait de fournir un justificatif m\u00e9dical. L&#8217;employeur peut demander un justificatif de la maladie (Self certificate pendant les 6 premiers jours) mais un certificat m\u00e9dical (appel\u00e9 Fit Note \/ Sick Note) n&rsquo;est l\u00e9galement requis qu&rsquo;\u00e0 partir du 7\u00e8me jour de maladie.<\/li><li class=\"p2\">L&#8217;employeur peut verser les SSP au salari\u00e9 pendant une dur\u00e9e maximum de 28 semaines.<\/li><\/ul><p class=\"p2\"><b>Si l&#8217;employ\u00e9 ne peut pas travailler \u00e0 cause du coronavirus (COVID-19) : <\/b><\/p><p class=\"p2\">Le programme de remboursement l\u00e9gal des indemnit\u00e9s de maladie li\u00e9es au coronavirus est maintenant ferm\u00e9. La date limite pour soumettre ou modifier une r\u00e9clamation \u00e9tait le 24 mars 2022.<\/p><p class=\"p2\"><b>Calcul de l\u2019indemnit\u00e9 : <\/b><\/p><p class=\"p2\"><b>Le montant hebdomadaire des indemnit\u00e9s est \u00e9gal \u00e0 <\/b><span class=\"s3\"><b>\u00a399.35. <\/b><\/span>Elles sont soumises \u00e0 l&rsquo;imp\u00f4t. L&#8217;employeur peut offrir davantage s&rsquo;il dispose d&rsquo;un \u00ab company sick pay scheme \u00bb aussi appel\u00e9 \u00ab \u2018contractual\u2019 or \u2018occupational\u2019 sick pay\u201d. Ce scheme doit \u00eatre inclus dans le contrat de travail.<\/p><\/div><p class=\"p2\">Les 3 premiers jours de maladie ne sont pas pris en compte dans le calcul de l&rsquo;indemnit\u00e9 SSP. Ces jours sont appel\u00e9s \u00ab <b>waiting days\u201d<\/b>. La d\u00e9finition des jours <b>waiting days <\/b>est bas\u00e9e sur les jours habituellement travaill\u00e9s par le salari\u00e9, comme les jours pris en charge, appel\u00e9s \u00ab <b>qualifying days<\/b>.<\/p><p class=\"p2\">Les 3 jours de waiting days sont uniquement pay\u00e9s si l\u2019employ\u00e9 \u00e0 d\u00e9j\u00e0 re\u00e7u des SSP au cours des derni\u00e8res 8 semaines ou si l\u2019employeur a ins\u00e9r\u00e9 une clause le sp\u00e9cifiant dans le contrat.<\/p><p class=\"p2\"><b>Exemple 1 <\/b>: si le salari\u00e9 travaille habituellement du lundi au vendredi et que son cong\u00e9 maladie d\u00e9bute le vendredi, les jours de carence seront le vendredi, le lundi et le mardi. Le calcul du SSP d\u00e9butera le mercredi.<\/p><p class=\"p2\"><b>Exemple 2 : <\/b>si le salari\u00e9 travaille habituellement le jeudi et vendredi seulement et que le salari\u00e9 est malade le vendredi, les jours de carence seront le vendredi du 1er jour de maladie, et les jeudis et vendredis de la semaine suivante. Le calcul du SSP d\u00e9butera le jeudi de la 3\u00e8me semaine si le salari\u00e9 est encore malade.<\/p><p class=\"p2\"><b>Attention ! Non \u00e9ligibilit\u00e9 aux SSP ou fin des SSP\u2013 formulaire SSP1 : <\/b><\/p><p class=\"p2\">L\u2019employ\u00e9 peut souscrire au \u00ab Universal Credit\u201d or \u201cEmployment and Support Allowance (ESA\u201d). L\u2019employeur doit lui remettre un formulaire SSP1 dans les d\u00e9lais suivants :<\/p><ul class=\"ul1\"><li class=\"li3\">dans les 7 jours de cong\u00e9 de maladie ( si pas \u00e9ligible aux SSP)<\/li><li class=\"li3\">dans les 7 jours de la fin des SSP, s\u2019ils se terminent de fa\u00e7on inattendue pendant que le salari\u00e9 est toujours malade<\/li><li class=\"li2\">au plus tard au d\u00e9but de la 23e semaine, si les SSP se terminent avant la maladie du salari\u00e9.<\/li><\/ul><p class=\"p2\"><b>Le salari\u00e9 ne pourra b\u00e9n\u00e9ficier des SSP si : <\/b><\/p><ul class=\"ul1\"><li class=\"li5\">Il a d\u00e9j\u00e0 re\u00e7u le montant maximum des SSP (28 semaines)<\/li><li class=\"li5\">B\u00e9n\u00e9ficie d\u00e9j\u00e0 des indemnit\u00e9s de cong\u00e9s de maternit\u00e9<\/li><li class=\"li2\">Doit \u00ab s\u2019isoler \u00bb apr\u00e8s leur entr\u00e9e ou leur retour au Royaume-Uni et n&rsquo;ont pas besoin de s&rsquo;isoler pour toute autre raison<\/li><\/ul><p class=\"p2\">N\u2019h\u00e9sitez pas \u00e0 nous contacter pour toutes questions !<\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Starting your business with us is easy!
