cong\u00e9s paternit\u00e9 en tant qu\u2019employeur.<\/p><h2 class=\"p1\">1. cong\u00e9 de paternit\u00e9<\/h2><p class=\"p1\">Le salari\u00e9 peut \u00eatre \u00e9ligible au cong\u00e9 de paternit\u00e9 s&rsquo;il est responsable de l&rsquo;\u00e9ducation de l&rsquo;enfant et<\/p><p class=\"p1\">soit :<\/p><ul><li class=\"p1\">le p\u00e8re biologique<\/li><li class=\"p1\">Son\/sa partenaire a un b\u00e9b\u00e9, adopte un enfant ou a un enfant par maternit\u00e9 de substitution<\/li><\/ul><p class=\"p1\">Si l&#8217;employ\u00e9 a un partenaire de m\u00eame sexe, cela s&rsquo;appelle toujours un cong\u00e9 de paternit\u00e9. Un partenaire peut prendre un cong\u00e9 de paternit\u00e9 et l&rsquo;autre peut prendre un cong\u00e9 de maternit\u00e9 ou un cong\u00e9 d&rsquo;adoption.<\/p><p class=\"p1\"><strong>L&#8217;employ\u00e9 peut prendre jusqu&rsquo;\u00e0 2 semaines.<\/strong> Il obtient le m\u00eame nombre de cong\u00e9s s\u2019il s\u2019agit d\u2019une naissance multiple (comme des jumeaux).<\/p><p class=\"p1\">Le cong\u00e9s doit \u00eatre pris en une seule fois. Une semaine correspond au m\u00eame nombre de jours qu&rsquo;il travaille normalement dans une semaine \u2010 par exemple, une semaine \u00e9quivaut \u00e0 2 jours s&rsquo;il ne travaille que les lundis et mardis.<\/p><p class=\"p1\">Pour avoir droit au cong\u00e9 paternit\u00e9, il doit :<\/p><ul><li class=\"p1\">\u00eatre l\u00e9galement consid\u00e9r\u00e9 comme salari\u00e9<\/li><li class=\"p1\">donner le pr\u00e9avis l\u00e9gal<\/li><li class=\"p1\">avoir travaill\u00e9 pour le m\u00eame employeur pendant au moins 26 semaines se terminant par la 15e semaine avant l&rsquo;accouchement<\/li><\/ul><p class=\"p1\"><strong>Dates de d\u00e9but et de fin<\/strong><\/p><ul><li class=\"p1\">Le cong\u00e9 ne peut pas commencer avant la naissance.<\/li><li class=\"p1\">Il doit se terminer dans les 56 jours suivant la naissance.<\/li><li class=\"p1\">il doit donner \u00e0 son employeur un pr\u00e9avis de 28 jours s\u2019il souhaite modifier la date de d\u00e9but.<\/li><\/ul><p>Il n&rsquo;a pas \u00e0 donner de date pr\u00e9cise \u00e0 laquelle il souhaite prendre le cong\u00e9 (par exemple le 1er f\u00e9vrier). Il peut donner p\u00e9riode g\u00e9n\u00e9rale, comme le jour de la naissance ou 1 semaine apr\u00e8s la naissance.<\/p><p class=\"p1\">Les r\u00e8gles sont diff\u00e9rentes s&rsquo;il adopte.<\/p><p class=\"p1\">Les droits du travail sont maintenus pendant le cong\u00e9 de paternit\u00e9 tels que :<\/p><ul><li class=\"p1\">l\u2019augmentation de salaire<\/li><li class=\"p1\">l\u2019 accumulation des vacances<\/li><li class=\"p1\">le retour au travail<\/li><\/ul><p class=\"p1\"><strong>Cong\u00e9 parental partag\u00e9<\/strong><\/p><p class=\"p1\">Il peut \u00e9galement \u00eatre \u00e9ligible au cong\u00e9 parental partag\u00e9 ( Shared Parental Leave \u2010SPL). Il ne peut pas prendre de cong\u00e9 de paternit\u00e9 apr\u00e8s avoir pris le SPL.<\/p><p class=\"p1\"><strong>Cong\u00e9 pour rendez\u2010vous pr\u00e9nataux<\/strong><\/p><p class=\"p1\">Il peut prendre un cong\u00e9 sans solde pour accompagner une femme enceinte \u00e0 2 rendez\u2010vous pr\u00e9nataux s&rsquo;il est \u00e9ligible (cf ci\u2010dessus).<\/p><p class=\"p1\">Il peut prendre jusqu&rsquo;\u00e0 6 heures et demie par rendez\u2010vous. L&#8217;employeur peut choisir de donner plus.<\/p><p class=\"p1\">Il peut demander un cong\u00e9 imm\u00e9diatement s&rsquo;il est un employ\u00e9 permanent. Il devra avoir travaill\u00e9 depuis 12 semaines avant d&rsquo;\u00eatre admissible s&rsquo;il est un travailleur int\u00e9rimaire.<\/p><h2 class=\"p1\">2. Cong\u00e9s Pay\u00e9s \u2010 Statutory Paternity Pay (SPP)<\/h2><p class=\"p1\">Le taux hebdomadaire l\u00e9gal de l&rsquo;indemnit\u00e9 de paternit\u00e9 est de 156.66 GBP (2022), ou 90% du salaire hebdomadaire moyen (selon le montant le plus bas).<\/p><p class=\"p1\">Cette indemnit\u00e9 est pay\u00e9e de la m\u00eame mani\u00e8re que son salaire, par exemple mensuellement ou hebdomadairement. L&rsquo;imp\u00f4t et le NI seront d\u00e9duits.<\/p><p class=\"p1\">Il y a des conditions suppl\u00e9mentaires que l&#8217;employ\u00e9 doit remplir pour avoir droit \u00e0 un cong\u00e9 et \u00e0 une r\u00e9mun\u00e9ration.<\/p><p class=\"p1\">Pour \u00eatre \u00e9ligible au cong\u00e9s pay\u00e9s r\u00e9mun\u00e9r\u00e9s, votre employ\u00e9 doit:<\/p><ul><li class=\"p1\">\u00eatre employ\u00e9 jusqu&rsquo;\u00e0 la date de la naissance<\/li><li class=\"p1\">gagner au moins \u00a3120 par semaine (avant taxes)<\/li><li class=\"p1\">donner le pr\u00e9avis l\u00e9gal<\/li><li class=\"p1\">Avoir \u00e9t\u00e9 employ\u00e9 de mani\u00e8re continue par l\u2019employeur pendant au moins 26 semaines, jusqu\u2019\u00e0 n\u2019importe quel jour de la \u00abqualifying week\u2019\u00bb<\/li><\/ul><p class=\"p1\">La \u00abqualifying week\u2019\u00bb est la 15e semaine avant l\u2019accouchement. C&rsquo;est diff\u00e9rent si vous adoptez.<\/p><p class=\"p1\"><strong>Dates de d\u00e9but et de fin<\/strong><\/p><p class=\"p1\">L\u2019indemnit\u00e9 est g\u00e9n\u00e9ralement pay\u00e9e pendant le cong\u00e9. L&#8217;employeur doit confirmer les dates de<\/p><p class=\"p1\">d\u00e9but et de fin de son indemnit\u00e9 de paternit\u00e9 lorsqu&rsquo;il la r\u00e9clame.<\/p><p class=\"p1\">Pour modifier la date de d\u00e9but, il doit donner \u00e0 son employeur un pr\u00e9avis de 28 jours.<\/p><p class=\"p1\">Il peut recevoir un salaire plus \u00e9lev\u00e9 si son employeur a une clause d&rsquo;entreprise sur le cong\u00e9 de<\/p><p class=\"p1\">paternit\u00e9 \u2013 il ne peut pas recevoir moins que le minimum l\u00e9gal.<\/p><h2 class=\"p1\">3.
